Item Pick Up Schedule
All articles, items or vehicles shall be removed from the sale area by the owner at their expense immediately following the auction. Buyers are responsible for all removal, loading, moving and hauling of all purchases. The auction company and/or the City of Charlotte do not have any way of loading vehicles/equipment. All items must be removed within 5 business days following the auction. Customers may remove items the day of the auction until 4:00pm, and the week of September 18-22, 2017 (see calendar below). Starting on September 25, 2017, customers will be charged a late fee of $25 per item. The late fee will increase by $25 per item each day following September 25, 2017.
The last day for item pick up is October 6, 2017. After this date, all remaining items will be towed off the lot at the buyer’s expense.

TITLES will not be given to the buyer on site. They will be mailed by USPS mail within 10 days of auction. Any announcements made at sale regarding the condition of vehicles or other items being auctioned supersedes descriptions made in program. Rogers Realty and Auction Co., Inc. reserves the right to refuse to register or to accept a bid from any person, corporation, partnership, joint venture, or other legal entity, which for any reason does not meet the sale terms. Subject to satisfactory payment by purchaser, at the fall of the auctioneer's hammer, ownership of item, articles or vehicle passes to the bidder designated by auctioneer saying 'sold' or otherwise declaring completion of sale. Thereupon the new owner assumes full responsibility for property purchased and agrees to the terms of the sale and further agrees to immediately sign a confirmation on the purchase price.

UNIFORM COMMERCIAL CODE: Section 2-328 of the UCC provides federal law regarding a sale by auction. The code reads that a sale by auction is complete when the auctioneer so announces by the fall of hammer or in other customary manner. A bid is a legal binding contract between bidder and auctioneer. Reopening a bid is at the sole discretion of the auctioneer. Failure to complete a payment in good faith, stopping payment on checks or refusing to pay for goods or assets purchased at auction may result in legal action against the buyer.
TECHNICAL PROBLEMS: The auction company provides online bidding as a convenience for those that cannot attend the live auction. The auction company will not be liable for any faulty equipment, failure of equipment, faulty software, failure of software, lack of internet service connections or signals, or failure for any online bids that are not relayed on time to the auction company. The auction company reserves the right to extend bidding, delay bidding, continue with live bidding, or cancel bidding, without any notice to online bidders.
DEFAULT OR DELAY: If the buyer does not pay in full for any reason they will be banned from attending auctions! The auction company reserves the right to reclaim and resale any assets not paid for by the online buyer. Should the resale price be lower than the defaulted buyer's price, Seller and/or Auction Company reserves the right to seek the difference from the initial online buyer. All fees for collection, court fees, or attorney fees will be the responsibility of the original buyer that caused the default. All sales are final. No refunds are given.
